TERMS OF USE

WARNING: The Haptics Connect software, including but not limited to mobile and desktop applications (the “App”), may be used to connect third-party software with third-party haptic or interactive devices that may generate physical sensations. The App is intended exclusively for individuals who are 18 years of age or older. If you are under the age of 18, you must not download, access, or use the App. If such use is illegal in your jurisdiction, or if you do not wish to be exposed to such use cases, do not download, access, or use the App.

THIS DOCUMENT CONTAINS IMPORTANT TERMS THAT AFFECT YOUR LEGAL RIGHTS AND REMEDIES. BY DOWNLOADING, INSTALLING, ACCESSING, OR USING THE APP, YOU AGREE TO BE BOUND BY THESE TERMS.

The terms “you,” “your,” and “user” refer to any individual or entity using the App.
The terms “we,” “us,” “our,” and “VRS” refer to V.R.S. VIRTUAL REALITY TECHNOLOGY LTD, the owner and operator of the Haptics Connect App.

These Terms and Conditions (the “Agreement”) constitute a legally binding agreement between you and VRS. If you do not agree to this Agreement, do not download or use the App and uninstall and delete it from your device immediately.

1. ACCESS TO AND USE OF THE APP

a. Eligibility

The App is available only to individuals who are 18 years of age or older.

By downloading, installing, accessing, or using the App, you represent and warrant that:

  • you are at least 18 years old;
  • you have the legal capacity to enter into this Agreement;
  • you will comply with this Agreement and all applicable laws and regulations.
  • by using the App, you acknowledge that you have read and understood our Privacy Policy and that your personal data will be processed in accordance with it.
  • if you use the App on behalf of a company or other legal entity, you further represent that you are authorized to bind that entity to this Agreement.

b. Permission to Use the App

Subject to your compliance with this Agreement, VRS grants you a personal, limited, worldwide, non-negotiable, non-exclusive, non-transferable, revocable, and royalty-free license to use the App solely for its intended purpose. This license is granted only to enable you to use the App as provided and does not transfer any ownership rights in the App or its underlying software.

You may not:

  • copy, modify, distribute, sell, lease, sublicense, or otherwise exploit the App;
  • reverse engineer, decompile, disassemble, or attempt to derive the source code of 
  • the App, except to the extent expressly permitted by applicable law;
  • bypass, disable, or interfere with any technical or security features of the App;
  • use the App for any unlawful purpose or in violation of this Agreement.

c. Our Control Over the App

VRS reserves the right, at its discretion and at any time, to modify, update, suspend, limit, or discontinue the App, or any part of its functionality, including supported features or integrations. VRS does not guarantee uninterrupted availability of the App or continued compatibility with any third-party software or devices.

VRS does not actively monitor, review, or assess any data, signals, scripts, content, or other materials transmitted or used through the App, except where required by applicable law or where necessary to protect the App, its users, or third parties.

You remain solely responsible for any data, content, scripts, commands, configurations, or other materials that you create, transmit, or use in connection with the App, including their legality, accuracy, safety, and compliance with applicable laws and third-party rights.

To the extent permitted by applicable law, VRS may take such measures as it considers appropriate to enforce this Agreement, protect the integrity of the App, or address legal, technical, or security concerns, including restricting or terminating access to the App.

The App may include informational messages, notices, or other communications related to the App or its operation. The presence of such communications does not constitute endorsement of any third-party product or service.

d. Third-Party Materials

Any scripts, commands, configurations, data, or other materials used in connection with the App may be created, generated, selected, or provided by users or third parties and may also be made available or created within the App.

VRS does not certify, review, verify, control, or endorse any such materials and assumes no responsibility or liability for their content, legality, functionality, safety, intensity, or suitability for any particular use or user.

Use of any such materials is at your own risk.

2. FUNCTIONAL SCOPE OF THE APP

The App operates as a technical connectivity and interoperability tool that enables communication or signal exchange between third-party software, services, or content and third-party haptic or interactive devices.

As part of its functionality, the App may include pre-made scripts and may allow users to create or configure scripts within the App. Any such scripts or commands are provided solely to enable technical connectivity and do not constitute recommendations, guarantees, or assurances regarding device behavior, intensity, safety, or suitability for any particular user or use case.

VRS does not manufacture, sell, distribute, certify, or warrant any hardware devices, and does not control or guarantee the performance, behavior, or physical effects of any device used in connection with the App. VRS does not determine or ensure the intensity, duration, 

frequency, or physical impact of any device action and does not provide medical, therapeutic, or safety advice.

Any physical sensations, device behavior, or other effects experienced while using the App result from third-party devices, third-party software, scripts, user configuration, or combinations thereof.

Use of the App does not create any professional, medical, or advisory relationship between you and VRS.

3. PRIVACY

Information about how VRS collects and processes personal data in connection with the App is described in the Privacy Policy, which forms an integral part of this Agreement.

By using the App, you acknowledge that you have read and understood the Privacy Policy and that any personal data processed in connection with your use of the App will be handled in accordance with it.

4. THIRD-PARTY COPYRIGHT

VRS respects the intellectual property rights of others and expects users of the App to do the same. We will take reasonable steps to address reports of copyright infringement in accordance with applicable law.

If VRS becomes aware that a user has repeatedly infringed third-party intellectual property rights in connection with use of the App, we may take appropriate measures, including restricting or terminating access to the App.

If you believe that any material used in connection with the App infringes a third-party copyright, please notify us by contacting legal@vrstreamtech.com and providing sufficient information to identify the alleged infringement.

5. SAFETY CONSIDERATIONS

You agree to use the App in a lawful, responsible, and appropriate manner and not to use it for any purpose that is illegal or prohibited under this Agreement.

Use of the App in connection with haptic or interactive devices may result in physical sensations and involves inherent risks. You are solely responsible for ensuring that any device, script, or configuration used with the App is used safely, appropriately, and in accordance with the manufacturer’s instructions, warnings, and intended use. You must stop using the App and any connected device immediately if you experience discomfort, pain, injury, or any other adverse effect.

You acknowledge that VRS does not provide medical, therapeutic, or safety advice and does not assess whether use of the App, any script, or any connected device is appropriate for your individual circumstances. You should consult a qualified professional if you have any health-related concerns before using haptic or interactive devices.

You must not misuse the App in a way that interferes with, disrupts, damages, or impairs its operation or security, including by attempting to gain unauthorized access, introducing malicious code, or circumventing technical or security measures.

You are responsible for ensuring that your use of the App and any connected devices does 

not distract you from complying with applicable safety or traffic laws and does not place yourself or others at risk.

6. ACCOUNTS AND SECURITY

Where the App includes account features, you are responsible for safeguarding your access credentials and for all activities carried out through your account.

Please notify us promptly if you believe your account security has been compromised. You can reach out to dev@vrstreamtech.com. 

7. DATA CHARGES

You are responsible for any internet, data, or network charges that may apply to your use of the App, including charges incurred for transmitting or receiving data.

If you are unsure what charges may apply, you should consult your service provider before using the App.

8. PRICING AND PRODUCT INFORMATION

The App is currently provided free of charge. VRS does not guarantee that the App will remain free in the future.

Any descriptions or information relating to the App are provided for general informational purposes only and may be modified, corrected, or updated at any time without prior notice.

9. AMENDMENT TO TERMS

VRS reserves the right, in its sole discretion, to amend, modify, or update these Terms or the App at any time.

Continued use of the App after any such changes constitutes acceptance of the updated Terms.

10. INDEMNITY

  • You agree to defend, indemnify, and hold harmless VRS, its directors, officers, employees, and agents from and against any third-party claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or related to:
  • your use or misuse of the App;
  • your use of any scripts, configurations, or connected devices;
  • your violation of these Terms or applicable law.

11. DISCLAIMER

THE APP IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VRS DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.

VRS DOES NOT WARRANT THAT:

  • THE APP WILL BE SECURE, UNINTERRUPTED, OR ERROR-FREE;
  • THE APP WILL FUNCTION WITHOUT DELAYS, FAILURES, OR IMPERFECTIONS;
  • ANY SCRIPT, CONFIGURATION, CONNECTION, OR DEVICE ACTION WILL OPERATE AS EXPECTED OR PRODUCE ANY PARTICULAR RESULT.

VRS ASSUMES NO RESPONSIBILITY OR LIABILITY FOR ANY SCRIPTS, CONFIGURATIONS, DEVICES, OR MATERIALS USED IN CONNECTION WITH THE APP, WHETHER PRE-MADE, USER-CREATED, OR OTHERWISE.

12. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VRS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING, WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO:

  • YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE APP;
  • THE USE OF ANY HAPTIC OR INTERACTIVE DEVICE IN CONNECTION WITH THE APP;
  • ANY SCRIPTS, CONFIGURATIONS, OR MATERIALS USED WITH THE APP;
  • UNAUTHORIZED ACCESS TO OR ALTERATION OF THE APP OR DATA.

IN NO EVENT SHALL VRS’S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE APP EXCEED USD 100, OR THE MAXIMUM AMOUNT PERMITTED BY APPLICABLE LAW, WHICHEVER IS GREATER.

13. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms and any dispute arising out of or relating to the App shall be governed by and construed in accordance with the laws of Cyprus, without regard to conflict of law principles.

Any disputes that cannot be resolved amicably shall be subject to the exclusive jurisdiction of the competent courts of Cyprus, unless mandatory law provides otherwise.

14. ENTIRE AGREEMENT

These Terms constitute the entire agreement between you and VRS regarding use of the App and supersede any prior or contemporaneous agreements or understandings relating to the App.

Except where mandatory law provides otherwise, any disputes between you and VRS that cannot be resolved amicably shall be subject to the exclusive jurisdiction of the competent courts of Cyprus. You waive any right to participate in a class action or other representative proceedings to the extent permitted by applicable law.

15. PREVAILING LANGUAGE

These Terms are drafted in English. In the event of any inconsistency between the English version and any translated version, the English version shall prevail.
